Baker McKenzie International Trade Compliance Update | March 2019 8585530-v6\WASDMS 2 World Trade Organization (WTO) Appellate Body appointed in February 2019 At the Dispute Settlement Body (DSB) meeting on the 25th, Mexico spoke on behalf of 73 WTO members, once again introduced the organization’s proposal, called for the establishment of a selection committee, appointment of new members of the Appellate Body, candidates for submission within 30 days, and committee within 60 days. Post suggestions. The Appellate Body currently has four vacancies, usually seven members, and the other two members will leave in December. The United States once again stated that it could not agree to the joint proposal. As explained in previous meetings, the United States stated that the systemic problems it has identified have not yet been resolved. These concerns include that the appeal ruling goes far beyond the text that stipulates WTO rules in areas such as subsidies, anti-dumping duties, countervailing duties, standards and technical barriers to trade, and safeguards. Although the appeal is limited to legal issues, the Appellate Body also issued advisory opinions on issues necessary to resolve the dispute and reviewed the fact-finding of the expert group. In addition, the United States stated that the Appellate Body claimed that although WTO members have not yet agreed to the WTO’s precedent system and have been ignoring the 90-day deadline for issuing a ruling, the panel must comply with its ruling. For more than a year, the United States has been calling on WTO members to correct the actions of the Appellate Body, as if it had the right to allow former members of the Appellate Body to continue ruling appeals after the expiration of their term. The United States will continue to insist that the WTO dispute settlement mechanism follows WTO rules and will continue to work hard to find solutions to these important issues. More than 20 WTO members intervened in this matter. These members largely reiterated the concerns expressed at previous DSB meetings, namely: Given that the terms of two of the remaining three members of the Appellate Body will expire in December, the Appellate Body will not be able to function and therefore the stalemate Increasingly worrying; according to Article 17.2 of the WTO Dispute Settlement Understanding, members are obliged to fill vacancies in the Appellate Body; and, although they are prepared to participate in discussions to end the deadlock, the issue of filling the vacancies and how to address the concerns of the Appellate Body The issues are different issues and should not be linked together. Many who participated in the discussion welcomed the discussions as part of the informal process initiated under the General Council to overcome the deadlock in the selection of members of the Appellate Body and encouraged all members to actively participate in the deliberations. Finally, the newly released FAQ 650-660 provides additional guidance on issues related to PdVSA's SDN designation and the scope of the previously released GL. This month, the Federal Trade Commission (FTC) issued a letter dated February 5, 2019. The content involves exaggerating "manufacturing", "manufacturing", or "manufacturing" claims in the United States. This letter is addressed to an attorney representing Whiteside Machine & Repair Co., Inc., and it concerns the extent to which Whiteside products (including router bits) are manufactured in the United States. Specifically, although Whiteside performs some manufacturing functions in the United States, the Federal Trade Commission stated that many of its products contain a large number of imported components. The letter reiterated the FTC’s long-standing position that "substandard US origin declarations in marketing materials-including claims that the product is "manufactured", "manufactured" or "manufactured" in the United States-may suggest to consumers All products advertised in the U.S. These materials are "all or almost all" manufactured in the U.S. The letter states: As discussed, the non-conforming U.S. origin statement in marketing materials-including the product is "manufactured", "manufactured" "Or "manufactured" in the United States-may suggest to consumers that all products advertised in these materials are "fully or almost completely" manufactured in the United States. However, although the FTC can take enforcement actions, it often attempts to cooperate with the company to make it compliant through remedial actions. The United Kingdom signs a continuity agreement with Israel and the Palestinian Authority On February 18, 2019, the Department of International Trade (DIT) announced the signing of the United Kingdom-Israel Trade and Partnership Agreement, which replicates the existing trade arrangements under the EU-Israel Joint Agreement As far as possible. It will take effect immediately after the implementation period ends in January 2021, and if the UK leaves the EU without an agreement, it will take effect on March 29, 2019. The trade continuity agreement simplifies trade and allows companies to trade freely as they do now, without any additional barriers or tariffs. The agreement will allow British businesses and consumers to benefit from continued trade with Israel after Britain leaves the European Union. The announcement partly stated: This will help further strengthen the trade relationship between the UK and Israel, which is worth 4 billion pounds in the year ending in the third quarter of 2018. If the agreement is not in place, the British auto industry can avoid export tariffs of up to 9 million pounds a year, while exporters of machinery and machinery equipment can avoid tariffs of up to 5 million pounds a year. The agreement also protects existing preferential market access for important products. British consumers will continue to benefit from more choices and lower prices of goods imported from Israel (such as pharmaceutical products), and Israeli companies will become the main suppliers of the NHS. On February 18, 2019, DIT also announced the signing of the United Kingdom-Palestine Authority agreement in Ramallah to replicate existing trade arrangements as much as possible. It will take effect immediately after the implementation period ends in January 2021, and if the UK leaves the EU without an agreement, it will take effect on March 29, 2019. The agreement simplifies trade and will allow companies to trade as freely as they do now after the UK leaves the EU. Trading on these preferential terms instead of WTO terms will continue to save a lot of money and help further strengthen bilateral trade relations. The agreement allows Palestinian companies to continue duty-free access to the UK market, which will continue to benefit Palestinian producers in priority sectors, including exporters of fruits, nuts and vegetable fats (including dates and olive oil). The UK is seeking to provide continuity to some 40 existing EU trade agreements covering more than 70 countries. The United Kingdom and the United States agree to continue the mutual recognition agreement. On February 14, 2019, the Department of International Trade (DIT) announced that the Mutual Recognition Agreement for Compliance Assessment (MRA) is the Baker McKenzie International Trade Compliance Update | March 2019 8585530-v6\WASDMS 55 Signed by Her Majesty’s Ambassador and Deputy U.S. Trade Representative in Washington on February 14. This arrangement, which helps to promote trade between the United Kingdom and the United States, will continue after the United Kingdom leaves the European Union to support employment in both countries. The announcement stated: When the EU-U.S. agreement no longer applies to the United Kingdom, the agreement will retain all relevant aspects of the current EU-U.S. MRA. It helps promote trade in goods between the two countries, which means that British exporters can continue to ensure that goods comply with technical regulations before leaving the UK, thus saving companies time, money and resources. The U.S. benefits British exporters in the same way. According to recent average trade flows, the total trade volume between the United Kingdom and the United States covered by the agreement is as high as £12.8 billion. Among them, the value of the covered British exports is estimated to be 8.9 billion pounds-more than one-fifth of the total British exports to the United States. Today’s signing marks a crucial step in an important trade relationship between the United Kingdom and the world’s largest economy, the United States. The agreement benefits a range of industries, including pharmaceuticals. Medicines accounted for approximately £7.7 billion of British exports to the United States, and accounted for nearly 18% of Britain’s total exports to the United States. Other industries that will benefit include the technology industry and telecommunications equipment suppliers. Similar agreements have been signed with Australia and New Zealand in recent weeks to ensure continuity and protect the incomes of British businesses and consumers. The British government issued a draft export control legislation to prepare for Brexit. On February 12, 2019, as part of the British government’s Brexit plan, the Department of International Trade issued the "Trade in Dual-Use Goods, Firearms, Torture, etc." (amendments) Case) (EU Withdrawal) Regulations 2019 ("Regulations"), available here. This is the latest draft of the statutory instrument issued by the Department of International Trade, amending the export control legislation and preparing for the UK's withdrawal from the European Union. The first of these instruments is the 2019 Export Control (Amendment) (EU Export) Regulations (available here), which amends provisions in the following domestic legislation: Radioactive Source Export (Control) Order 2006 and 2008 Export control orders and other domestic subsidiary legislation related to the EU sanctions regime. The regulations amend the retained EU legislation to ensure that its provisions operate in accordance with British rules after withdrawal. It revised the following:  Council Regulation (EC) No. 1236/2005 of June 27, 2005, which deals with the rules on trade in goods that can be used for the purpose of death penalty or torture;  May 5, 2009 ( EC) Council Regulation No. 428/2009, which establishes a community system to control the export, transfer, intermediary and transfer, intermediary and transit of dual-use goods;  European Parliament and Council Regulation No. 258/2012 ( European Union), implement Article 10 of the "United Nations Protocol on Combating the Illicit Manufacturing and Trafficking of Firearms, Their Parts and Components and Ammunition." The UK government issues a no-deal Brexit OGEL As part of the UK government’s no-deal Brexit plan, the UK Department of International Trade (DIT) has issued an Open Universal Export License ("OGEL"), allowing the export of dual-use products from the UK to EU members Articles (with civil and military applications) of the country and the Channel Islands (full license here). If the UK leaves the EU on that date without reaching an agreement or withdrawing from the transition period, OGEL will take effect at 11pm on March 29, 2019. In order to use the license, the exporter must first register through the British government's export control electronic licensing system SPIRE, stating that export and transfer records will be kept, and specifying where it may be inspected. OGEL applies to all products listed in Annex I of Regulation (EC) No. 428/2009, excluding those listed in Annex IV. OGEL also replicates the current exclusion clauses for Annex I goods exported outside the EU, and excludes goods belonging to Annex I if: related to nuclear weapons or military items;  The exporter knows that such items are or may be used for nuclear weapons Or military items; or  The exporter has reason to suspect that such items are being or may be intended for nuclear weapons or military items, unless the exporter has conducted all reasonable investigations regarding the intended use. Finally, the license is accompanied by specific management conditions and requirements:  Record keeping obligations (at least 3 years from the end of the calendar year in which the export occurs);  Notifying the Secretary of State of the name of the exporter and the address where the above records are kept;  In the goods Attach a description explaining the goods exported under OGEL (or provide its SPIRE reference). Baker McKenzie International Trade Compliance Update | March 2019 8585530-v6\WASDMS 57 The United Kingdom, Chile and the United Kingdom-Faroe Islands sign a continuity agreement. Chile January 30, 2019, the Ministry of International Trade announced the signing of the establishment of the Great Britain and Northern Ireland Union Agreement between the Kingdom and the United Kingdom of Northern Ireland. The Republic of Chile (UK-Chile Agreement), a trade continuity agreement between Chile and the United Kingdom. The United Kingdom-Chile Agreement will ensure that the products of each country will continue to benefit from preferential trade arrangements after the United Kingdom exits the European Union on March 29, 2019 or after the implementation period, if the United Kingdom and the European Union succeed in negotiations. The UK is expected to sign a series of other agreements in the coming weeks. The announcement stated: British manufacturers benefited from preferential access to the Chilean market to sell their products, and British consumers benefited from the lower prices of Chilean products, such as wine, fruits and nuts. Since the agreement was temporarily applied in 2003, trade in goods and services between the United Kingdom and Chile has grown by an average of 9% per year. British exports to Chile have grown by an average of 16% per year, a total increase of 351% since the agreement came into effect. The agreement applies temporarily. The agreement also protects intellectual property rights and maintains preferential market access for service trade. It will also allow British and Chilean companies to bid for some public sector contracts in each other’s countries, helping to create jobs and provide better value to taxpayers. Faroe Islands On January 31, 2019, the United Kingdom and the Faroe Islands signed a trade continuity agreement. Exports from the Faroe Islands are important to the British processing industry. In 2017, nearly 200 million pounds of fish and crustaceans entered the UK from the Faroe Islands. The agreement will allow imports to continue to be duty-free and allow companies to trade as freely as they do now. Trading under these preferential terms will ensure savings and help guarantee access to fish products from the Faroe Islands. Consumers in the UK may benefit from more choices and lower prices for fish and seafood such as Atlantic salmon, haddock and halibut. This will ensure that British retailers and consumers have access to fresh, high-quality and affordable products at any time. The new agreement replicates existing trade arrangements as much as possible. They will take effect immediately after the implementation period ends on January 2021 or March 29, 2019 (if the UK leaves the EU without an agreement).
